La Ciudad de Buenos está en la antesala de una gran transformación histórica. La instauración de los gobiernos comunales marcará un nuevo escenario en relación a su organización política e institucional.
Las Comunas son el instrumento de la Democracia Participativa consagrada en la Constitución de la Ciudad, son la oportunidad para que los Ciudadanos sean protagonistas en la toma de decisión de la gestión barrial. Tenemos la posibilidad de rehacer el Estado en la Ciudad de Buenos Aires a partir de la puesta en marcha de las comunas, podemos tener un gobierno más cercano integrado por vecinos que los vecinos conocen.
Desde la consagración de la descentralización como principio constitucional en 1996 hasta hoy esta idea fundacional encontró resistencias en el conjunto del sistema político y en las corporaciones, obviamente renuentes a ceder poder político y aún administrativo.
En 2005, cuatro años después del plazo fijado por la Constitución de la Ciudad para constituir las Comunas se sanciona la Ley 1777, luego de un amplio proceso participativo en el que la Comisión de Descentralización fue barrio por barrio a debatir con los vecinos los contenidos de la Ley Orgánica de Comunas. La fecha límite establecida por esta Ley para completar el proceso de transición – 31 de mayo de 2007 – tampoco se cumplió.
Esta nueva frustración derivó en la desmovilización de gran parte de los miles de ciudadanos que participaron en aquel proceso con la expectativa de protagonizar el cambio fundacional del que hablábamos. Pero muchos otros siguieron al pie del cañón desde los Consejos Consultivos autoconvocados y participando de la Comisión Bipartita de Control y Seguimiento del proceso de transición a las Comunas creada por la Ley 1777.
En octubre de 2009, a partir de un fallo del Tribunal Superior de Justicia, en una acción de amparo promovida por aquellos vecinos que persistieron en la lucha por profundizar la democracia participativa consagrada en la Constitución, la Legislatura sancionó la Ley 3233 fijando en el 5 de junio de 2011 la fecha en que los ciudadanos de la Ciudad elegirán a quienes los representarán en las 15 Juntas Comunales a partir del 10 de Diciembre de 2011.
Esta Ley establece también algunas pautas que el Poder Ejecutivo debe cumplir en el proceso de transición, que tienen que ver fundamentalmente con informar al conjunto de la ciudadanía para promover la más amplia participación y con generar las condiciones materiales y normativas necesarias para que los órganos de gobierno comunales puedan gestionar efectivamente, cumpliendo con el cronograma previsto en la Ley 1777.
Hay que decir que, nuevamente, se está produciendo una mora importante en el cumplimiento de este proceso. El Plan de Comunicación puesto en marcha por el Poder Ejecutivo es insuficiente y se pierde dentro del marketing general de la gestión y del partido de gobierno, tal como lo afirma el informe elaborado por Poder Ciudadano, ADC y CIPPEC (>> ver informe >>) a pedido de la Presidencia de la Comisión. Además, el Poder Ejecutivo vetó la Ley 3489 que ordenaba la distribución de información sobre el tema junto a las boletas de ABL, perdiéndose así el segundo semestre de este año en la utilización de esa vía de difusión.
Por otra parte, a la fecha no se ha presentado el Programa de transferencia de competencias y servicios que dispone la Ley ni se conoce que haya un plan para dotar a los futuros gobiernos comunales de sedes y recursos humanos adecuados a las funciones que deberán asumir.
Nadie participa de lo que no sabe qué es. La cuestión es, entonces, concientizar, educar, discutir la trascendencia política que tienen las comunas, que redefinen una nueva institucionalidad en la Ciudad. Por ese motivo la Comisión de Descentralización y Participación Ciudadana viene realizando una recorrida por cada una de las comunas, cada quince días. Es importante que se involucren asociaciones vecinales, clubes de barrio, iglesias, organizaciones de comerciantes, que todos se sumen a empezar a incorporar las comunas como una realidad propia.
En este mismo sentido -maximizar la incorporación de todos los vecinos al nuevo modelo de gestión- en la actualidad se están tratando en la Comisión varios proyectos tendientes a ampliar la participación de los residentes extranjeros. Generar en el marco de la Reforma Política la posibilidad de constituir partidos comunales contribuirá también en esta misma dirección.
Está claro que en los lugares donde hay involucramiento de los vecinos la gestión es mejor, menos corrupta y da mejores respuestas. Es imprescindible que la convocatoria a participar sea amplia, abierta, democrática. Instar a incorporarse a la mayor cantidad de organizaciones de la sociedad y ciudadanos para imprimirle el grado más alto de participación posible. Solo así, las Comunas, podrán expresar la diversidad de actores que tienen en su seno y llegar a los consensos necesarios para la resolución de cada necesidad y de cada conflicto.
